Uma aproximação realista sobre as formalidades do direito autoral

Resumo

Rejeitando a história convencional de que as formalidades no direito autoral foram abolidas por a Convenção de Berna, este artigo demostra que os sistemas de formalidades administrados privadamente jogam um papel importante, a nível mundial, na administração do direito de autor. Efetívamente, devem fazêlo, porque o direito autoral é concebido para ser o soporte de uma estrutura de transações, que exige que os titulares -em busca de atrair sócios de licenças- se submetam a alguma etapa formal para se identificar eles mesmos e às obras em que eles tenham um interés jurídico ou de usufruto. Analisando o cenário dos sistemas de formalidades públicos e privados, tanto obrigatórias como voluntárias, este artigo argumenta que: 1) Sob a Convenção de Berna, os governantes nacionais manter uma maior autoridade política para impor determinados requisitos formais aos titulares, do que aqueles com uma compreensão formalista das formalidades públicas argumentam; 2) os sistemas privados de formalidades são variados e de grande importáncia económica, mas em muitos casos não são interoperavéis entre si, ou com registros voluntários ou outros sistemas voluntários de formalidades públicas; e 3) as autoridades devem utilizar uma combinação de abordagens para melhorar o funcionamento dos sistemas de formalidades tanto públicos como privados, promovendo ou exigendo tranparência, eficiência e interoperabilidade em sua concepção e implementação.
